Yinghua Academy Labor Condition Applications
Is Yinghua Acedemy an H-1B Dependent Employer?
Debra Schneider prepared 24 Labor Condition Applications submitted to the U.S. Department of Labor for Yinghua Academy for the 2017-2018 academic school year. Ms. Schneider reported Yinghua Academy is not an H-1B dependent employer.
Yet, after reviewing all the Labor Condition Applications it is quite clear Yinghua Academy is an H-1B dependent employer and Ms. Schneider consistently furnished incorrect or false information to the U.S. Department of Labor to obtain H-1B visas. According to information from the Minnesota Department of Education, Yinghua Academy employs 47.69 total licensed staff and support staff FTE. If we use this reported staff figure, 50% of their teaching staff are H-1B workers. This figure is considerably higher than the 15% cutoff line used to determne an H-1B visa dependent employer. Even using the listed 108 employees the percentage would be 22%. This would still be 7% over the maximum percentage allowed. This figure includes administration, classrooms teachers, specialist teachers and other support staff. Some of these employees would be employed part-time, such as the after school daycare workers. Therefore we can clearly see Ms. Schneider falsified or misrepresented material facts on all of the submitted Labor Condition Applications.
