Is Lakes International Language Academy H-1B Visa Dependent? 


Lakes International Language Academy, a public charter school in Forest Lake, Minnesota, consistently supplied incorrect or false information on the Labor Condition Applications submitted to the U.S. Department of Labor. 

For the 2017-2018 academic school year Lakes International Language Academy sponsored 27 H-1B visas for members of its teaching staff. The majority of these temporary non-immigrant workers are employed at the lower school campus with a much smaller number at the upper campus located at19850 Fenway Avenue North in Forest Lake, Minnesota

Igbanugo Partners prepared 26 of the 27 Labor Condition Applications for Nonimmigrant Workers ETA Form 9035. All of the LCA applications prepared by Igbanugo Partners reported Lakes International Language Academy is not an H-1B dependent employer. Only the Labor Condition Application prepared by a law firm in Chicago correctly answered Lakes International Language Academy is H-1B dependent. 

Lakes International Language Academy is an H-1B dependent employer and Igbanugo Partners consistently furnished incorrect or false information to the U.S. Department of Labor to obtain H-1B visas. According to information from the Minnesota Department of Education, Lakes International Language Academy employs 63.49 staff members at the Lower School and employs 29.95 staff members at the Upper School for a total of 90.44 staff members. 

If 27 of its staff members are H-1B workers that would equate to almost 30% of the total staff being H-1B workers, well above the prescribed 15% needed to be a H-1B dependent employer. Therefore, Igbanugo Partners willfully falsified or misrepresented material facts on the Labor Condition Applications.

Non-Licensed Community Experts


Non-Licensed Community Expert: A special permission granted to a school district to hire an individual who is not a licensed teacher, but has a specific area of expertise related to the teaching assignment. A bachelor’s degree is not required. Used in circumstances for when a teaching license does not exist, or when used to fill a teaching vacancy when no fully licensed teacher is available. NLCE may be renewed annually with no limit on the number of years.

Other penalties apply as well to fraud or misuse of this immigration document (U.S.C. 1546) and to perjury with respect to this form (18 U.S.C. 1546 and 1621).”

1907. Title 8, U.S.C. § 1324(a) Offenses 

Title 8, U.S.C. § 1324(a) defines several distinct offenses related to aliens. Subsection 1324(a)(1)(i)-(v) prohibits alien smuggling, domestic transportation of unauthorized aliens, concealing or harboring unauthorized aliens, encouraging or inducing unauthorized aliens to enter the United States, and engaging in a conspiracy or aiding and abetting any of the preceding acts. Subsection 1324(a)(2) prohibits bringing or attempting to bring unauthorized aliens to the United States in any manner whatsoever, even at a designated port of entry. Subsection 1324(a)(3).
Harboring -- Subsection 1324(a)(1)(A)(iii) makes it an offense for any person who -- knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation.
Conspiracy/Aiding or Abetting -- Subsection 1324(a)(1)(A)(v) expressly makes it an offense to engage in a conspiracy to commit or aid or abet the commission of the foregoing offenses.
